Jordan Peterson; Armed Forces Mandate; upcoming events
Jordan Peterson lost his judicial review of the re-education requirements the Ontario College of Psychologists imposed on him. Reactions here and here and here. As always I’m not a lawyer, but I think this decision will chill speech for all professions across the country. In my non legal opinion it also sets a very low standard for tribunals of all kinds to meet when dealing with Charter freedoms. So much for hopes that Vavilov would improve judicial review. How can the Supreme Court expect tribunals to have any special expertise in interpreting the Charter? As Ian Runkle points out, how about making “correctness” the standard of review for Charter decisions by tribunals instead of “reasonableness”. Let’s hope that Dr. Peterson appeals, although I couldn’t blame him if he gives up on our courts.
On a somewhat brighter note, the Military Grievances External Review Committee which found that the Canadian Armed Forces COVID-19 vaccination policy was unconstitutional.
