Dr. Kulvinder Kaur Gill denied judicial review; WHO Pandemic Treaty/Regulations
Hat tip to The Sunday Evening Law Review. Dr Gill has been an early and outspoken opponent of various COVID-19 policies especially on Twitter, resulting in a number of proceedings against her in various bodies of the College of Physicians and Surgeons of Ontario. She was cautioned but retained her medical licence. The Ontario Superior Court of Justice just denied her request for judicial review. This is similar to the Dr Jordan Peterson case. The court is basically saying you weren’t harmed very much so the tribunal doesn’t have to pay very much attention to your Charter 2b right to freedom of expression. I find it concerning that the court views Charter 2b freedom of expression solely as an individual issue as opposed to a society wide issue. I think the court is entirely missing the critical importance for society as a whole that health care professionals be able to speak out without fearing undue process. I think it’s important for democracy to carefully scrutinize even small infringements of Charter 2b. Also I think the court completely ignores just how socially important Dr Gill’s speech actually was. This court is on a slippery slope to tyranny.
